Proposed Guidance Sets the Bar for Financial Services Firms Concerning Their Electronic Communication

NASD/NYSE guidelines for electronic communication have specifically included:
- Employing a risk-based approach to identify violations
- Reviewing of internal messages for violations
- Flagging messages that may evidence or contain potential violations or customer complaints
- Pre-send review and approval of messages where appropriate
- Establishing policies and procedures for a supervisor to review messages that are in violation
“While transaction systems such as ERP and CRM in financial service environments
have the appropriate controls around them to avoid abuse and violations, electronic
action remains control-free. This puts organizations at substantial risk,” said
